Litigation Support / Expert Witness Testimony, Sample Cases

Potential Health Effects of Long-Term, Low-Level Exposure to Tear Gas: As testifying expert, provided an affidavit on long-term toxicity of CS (a tear gas or minimally lethal weapon). Nearly 50 reviews, experimental studies, and human epidemiological studies on tear gas toxicity were critically reviewed. Results from 24 studies were analyzed and interpreted in order to identify a hierarchy of effects of increasing severity from exposure to tear gas and the concentrations associated with those effects (including no observed adverse effect levels). This information was used to develop weight-of-evidence opinion related to whether tear gas was likely to produce health effects (including respiratory sensitization) at predicted concentrations. The judge's order on summary judgment specifically cited this work as constituting sound science.

Childhood Blood Lead Evaluation/Infant Lead Poisoning: Topics addressed over several cases included seasonality of blood lead levels, realistic rates of decline following elimination of source/exposure, benefits and drawbacks of venipuncture versus fingerprick (capillary) sampling methods, timing of exposure in light of central nervous system developmental stage, and potential for prenatal exposures (illicit drugs) to cause similar adverse effects.

Background Research of Animal Studies: As overall preparation in anticipation of litigation, conducted research over the course of two years on historical (as far back as the 1950s) animal toxicity data related to a specific toxicological endpoint (specific type of cancer).

Potential Health Effects of One-Time Exposure to Hydrogen Sulfide (H2S): As testifying expert, lead team evaluating the toxicity of hydrogen sulfide (H2S) and sulfur dioxide (SO2) in the context of a specific industrial accident. Two distinct expert reports were prepared as were comments on opposing experts' reports. Nearly 50 reviews, experimental animal studies, and human studies on hydrogen sulfide toxicity were ordered and critically reviewed. Results from more than 20 studies were analyzed and interpreted in order to idenfity a hierarchy of effects of increasing severity from exposure to hydrogen sulfide and the concentrations associated with those effects (including no observed adverse effect levels). This information was used to develop weight-of-evidence opinions related to the potential for predicted concentrations of hydrogen sulfide to produce health effects.

Superfund, Responsibility for Clean-up Costs: Provided testimony at a bench trial related to whether the sole non-settling party at a Superfund site was a source (as both a generator and an owner/operator) of each chemical driving risk and remediation at the site.

Release to Groundwater from a Retail Gasoline Station: Expert witness at a jury trial (including deposition) in Georgie related to potential adverse effects of petroleum products released from a gas station.

Potential Health Effects of Dry Cleaning-Type Solvent in Groundwater under Residences: Provided expert testimony on human health risk at a jury trial to determine the impact of off-site contamination on the value of adjoining property.
